Saraki: Appeal court admits David Mark's case judgment

The Appeal Court sitting in Ilorin, Monday, admitted the judgment of the Makurdi division of the Appeal Court which nullified David Mark's election as evidence for appeal filed against Dr. Bukola Saraki over the March 28 Kwara Central Senatorial election.

Abdulrahman Abdulrasaq of the Peoples Democratic Party (PDP), who contested for the same seat, challenged the election of Saraki at the election petitions tribunal which upheld Saraki's election in October.

Abdulrasaq also appealed the judgment of the tribunal, seeking nullification and rerun of the election.

?Barr. Mutiu B. Ganiyu, who led the counsels for Abdul rasaq, while presenting the judgment of the Makurdi Appeal Court in the case of David Mark, prayed the court to allow their client's appeal and nullified the election.

Ganiyu also informed the court of their decision to accept the reply of respondents as their arguments before the court. The counsel, therefore, insisted that the documents tendered as evidence before the tribunal and the appeal court showed that collations were still going on in some wards when the result was announced.

Meanwhile, counsel to Bukola Saraki, Yusuf Ali (SAN), prayed the court to dismiss the appeal in its entirety for lack of merit. He added that the authority cited by the appellant's counsel was irrelevant, adding that there was no similarity between the two cases.

He said: "No single result was brought out to back their argument at the lower tribunal. All the evidences were packed in sacks. For this reason, therefore, I urge the court to dismiss the case."

Also speaking, the counsels to All Progressive Congress (APC) and Independent National Electoral Commission, (INEC) Abdulwahab Bamidele and Tunde Salako, also prayed for the dismissal of the case for lacking in merit and upholding the judgment of the lower tribunal.

They adopted the argument of Saraki's counsel as part of reasons for calling for the dismissal of the case.

?The Presiding Judge of the Appeal Court, Justice J.S. Ikyegh, admitted the case cited and reserved judgment. The date for the judgment, the judge said, will be communicated to the parties involved.
